Becoming a homeowner on Hilton Head Island has wonderful benefits that obviously include beautiful beaches, exceptional golf and tennis facilities and exceptional community activities. One of the most enjoyable activities is hitting the water on a boat and enjoying all of the surrounding areas close to Hilton Head Island.

1. Options to Get Out on the Water

Let’s start with a few options you have for getting out on the water. You can obviously choose to buy your own boat and choose to trailer it back and forth to the water or store it at one of the many marinas the island has to offer.

Another, lesser know but super convenient option is becoming part of a boat club. The Freedom Boat Club is located at Palmetto Bay and Skull Creek marinas. The Club gives you access to over 60 vessels at any given time for you to use and enjoy but without the need to maintain and store your own boat. This is an excellent option for those who just want access to the water but not own a craft themselves.

2. Storing Your Boat

If you have or want to buy your own vessel, then there are a number of places you can look at to store/keep it. Here is a list of marinas and if they are slip only storage or offer dry stack storage. Of course, all are subject to availability.

3. Where to Go and What to See

Owning your own or being part of a boat club on Hilton Head Island gives you access to so many wonderful things to do and places to see. You can boat from one marina to the other and stop off for a nice lunch or dinner at places like Harbourtown or Skull Creek restaurants, Palmetto Bluff or venture into downtown Bluffton or Beaufort’s waterfront.

You can venture over to Daufuskie Island and enjoy the day at Freeport Marina and even rent golf carts to tool around the island for the day. Take a day trip to Savannah and dock right up to River Street or venture out at low tide and go beach your boat on the “redneck riviera of the south” at the May River sand bar. Enjoy incredible views along the many waterways that connect all of these places via the many marsh inlets that are boat friendly.

If you are even more adventurous you can take overnight trips along the intercoastal waterway up to Charleston and beyond, or head south and visit the Georgia and Florida coastlines, as well.

Beyond leisure and sunset cruises you will have access to some of the best fishing, crabbing and oystering around. Stay inshore and fish for Cobia, Founder, Red Fish and Trout. Head offshore to several manmade reefs to catch Seabass, Mackerel, Red Fish and much more. If you want to have an exciting fishing trip, head over to the Port Royal Sound which is the #1 breeding ground for Black Tip Sharks in the world.

Purchasing property for rental income on Hilton Head Island can be both lucrative and enjoyable. However, as of January 2023, a new town ordinance requires all short-term rental property owners to obtain a business license, maintain a permit, and collect and pay taxes. Understanding these requirements is crucial to successfully managing your short-term rental.

What is a Short Term Rental?

On Hilton Head Island, a short-term rental is any residential property rented for less than 30 days. All short-term rental permits are valid from January 1st through December 31st of the issuance year. Not all communities allow Short Term Rentals, so make sure you know for sure whether or not you can put a property on the Rental Market. Check with one of our experienced agents for more information.

Obtaining a Town Of Hilton Head Business License

Before applying for a short-term rental permit, you must first obtain a Town of Hilton Head Property Rental Business License. Here’s what you need to know:

  1. Business License Fee: The fee is $10 as of 2023.
  2. Annual Tax: License holders must pay an annual tax based on their gross rental revenues.
  3. Tax Withholding: You are required to withhold 11% in state and local taxes for each rental. This includes:
      5% state sales tax
      2% state accommodation tax
      2% town beach preservation tax
      1% town accommodation tax
      1% Beaufort County Green Space tax

Applying for a Short-Term Rental Permit

After obtaining your business license, you can register and complete your application for a short-term rental permit. Here’s how:

  1. Registration: Visit the Hilton Head Island government short-term rental permit portal.
  2. New User Registration: Register as a new user or link your existing business license profile to your rental property account.
  3. Site Plan: A site plan is required for single-family residential properties. Villas/condos do not require a site plan.
  4. Permit Fee: The permit fee is $250 per property as of 2023.
  5. Approval Time: Application approval may take up to 30 days. You will be notified by email about the status of your application.

Requirements for Short-Term Rental Permits

Simply applying for and obtaining a permit is not enough. Hilton Head Island maintains specific requirements for short-term rental owners:

Owner Responsibilities
  • Availability: The owner or rental agent must be available by phone at all times.
  • On-Site Action: The owner or rental agent must be able to take responsible action within one hour of a complaint and prominently display contact information in the rental property.
  • Outreach Materials: Display any town-provided outreach materials.
  • Property Maintenance: Regularly inspect and maintain the property to ensure compliance.
Parking Regulations
  • Notify Guests: Inform guests of the maximum number of vehicles allowed before making any agreement.
  • Parking Spaces: Ensure parking spaces are at least 9 feet by 18 feet and on an improved surface.
  • Off-Site Parking: Guests should not park on the street or grass.
Trash Regulations
  • Display Instructions: Provide clear trash removal instructions, including pick-up times and any property owner association requirements.
  • Storage Area: Maintain a designated, fenced, or screened trash storage area. Ensure trash containers are not visible from the street and are placed curbside no more than 24 hours before and removed within 24 hours after pick-up.
Noise Regulations
  • Inform Guests: Notify guests of the town’s noise regulations before making any agreement.
  • Display Regulations: Prominently display the following:
    • It is unlawful to unreasonably disturb the peace in homes and public places.
    • Quiet hours are between 10 pm and 7 am, but noise regulations are enforced 24/7.
Safety Regulations
  • Smoke and CO Detectors: Maintain fully operational smoke and carbon monoxide detectors.
  • Fire Extinguishers: Keep at least one fully operable and charged fire extinguisher.
  • Escape Routes: Ensure unobstructed escape routes in case of fire.
  • Pool Safety: Inform guests in writing about any pool or hot tub and related safety equipment before making any agreement.

Understanding property taxes is a crucial aspect of homeownership, yet it can often feel complex and daunting. In South Carolina, property taxes are calculated based on various factors, including the property's sales price and its classification as a primary residence or a vacation/second home. The disparity in tax rates between residents and non-residents, particularly concerning school taxes, may seem unfair at first glance.

However, South Carolina's tax rates remain relatively low compared to other regions in the country, making it an attractive destination for homebuyers seeking favorable tax environments.

Initially, the property taxes are based on your sales price. As a rule of thumb, if it’s a primary residence it’s about 0.08% of the price you paid and if it’s a vacation/2nd home property it’s about 1.2% of the selling price. So, on a $1 million home, property taxes would be about $8,000 per year for a resident and $12,000 per year for a non-resident.

The difference is largely because, as unfair as it seems, the school taxes are paid by non-residents and if it is classified as a primary residence, the owner pays no school tax.

Despite this seemingly unfair discrepancy, South Carolina taxes are among some of the lowest in the country, especially compared to the northeastern United States where most of our buyers come from.

Properties are reassessed by the State every five years. Generally speaking (but not always), the new “assessed value” is at least 10% less than the true “market” value. Occasionally, a property owner might feel that assessed value is higher than the market value and, in that case, the owner can appeal the assessment.

Another handy tool is the Beaufort County Tax Calculator which you can get to with a simple, internet search. However, remember that not all areas of Beaufort County are taxed the same. They're going to judge how well you take care of the things they can't see by the attention to detail of the things they can. Trim tags and loose threads on linens, label light switches for easy navigation, and provide an informational book with essential details about the property and its surroundings.

I can hear it now. "I'm not good a technology!" Trust me, this doesn't take an IT degree to add some modern touches to your investment property. One of the great things about Hilton Head Island, SC is how thoughtfully it has been planned out and incorporates the beautify of its natural surroundings throughout its many communities. But apart from street signs, you traditionally don’t see one thing in these communities – fences.

I recently was met with a buyer couple who were starting their home buying process on Hilton Head Island. After going over what they were looking for in a home and their want/needs list, we spoke a bit about their dog (because who doesn’t love to chat about their furry friends?) and they were concerned about it leaving safety of their new yard.

I explained to my buyers that because of the way Hilton Head Island was first planned out, many communities do not allow fences in yards apart from natural fencing. We spoke a bit about how to incorporate landscape architecture to create natural barriers and fencing using shrubs and hedges, but I understood that would not keep Fido safe. I also informed them how many communities will make exceptions for a pool, especially for safety reasons. But the requirements are still pretty tight and often requirement a wrought iron or aluminum posts and their small dog could get out of pretty easily. The solution for us was simple!

So, what did we end up doing? We focused on communities on the Island that allowed for fences or invisible pet fences, and also on properties that already had a fence approved and grandfathered into the property.

To make sure my buyers weren’t wasting their time looking at property that didn’t have a fence of some sort, I reviewed every property before it was sent to my buyers to make sure it met their home requirements and kept Fido safe. My buyers ended up in a home that met their requirements and were able make sure all their loved ones were protected and safe.

Understanding Monthly Regime Fees

In the realm of villa ownership, understanding monthly regime fees is essential for budgeting and financial planning. These fees, which cover various maintenance and amenities, are determined by several factors set by the owners' association and property management company. Let's delve into the intricacies of how these fees are determined and what variables impact their cost.

All “villas” are legally condominiums, and there is a monthly fee, which generally covers all exterior maintenance, Landscaping, amenities such as pools, trash, removal, pest control, and insurance.

The actual amount is determined by the owners’ association/board of directors (the “Regime”), as well as the property management company that is hired by the board of directors.

There are many variables that determine the amount of the monthly Regime fee, which is then prorated according to the square footage of the respective units within the complex. So, a smaller one bedroom will, of course, have a smaller fee than a two bedroom or three bedroom unit.

One of the biggest variables is how much land needs to be cared for. For example, you might have a complex that has 40 units, all one story, on 15 acres. Conversely, you might have a five-story property with 150 units on 9 acres, so much less land to take care of.

A second variable is how much of the monthly fee will be set aside for capital reserves. Some Regimes want to have a higher monthly fee with a higher amount of that monthly fee, being set aside for periodic large scale, capital, improvement, projects, such as repaving, parking, lots, roofing, etc. That way, when the time comes for such a large scale projects, there are often adequate funds on hand, so there will not be an assessment or, if there is one, it will be relatively small.

Other Regimes would rather keep the monthly fee lower, and have a smaller percentage of the monthly fee being set aside for capital improvements. In this case, when large projects need to be funded, there will not be enough in the capital reserves, and therefore there will be an assessment to the owners which is usually spread over one or two years.

Yet a third factor that is beyond the control of the Regime, but can definitely affect the amount of the monthly fee, is the amount of insurance that is required. For example, an older property on a lower elevation relative to sea level, will have a substantially higher insurance premium than a newer property that is lower risk because of a higher elevation.
